Orders, payment processing, and purchase terms
Placing an order

When you place an order on my website, you offer to purchase goods from Simon Aiken under these terms. All orders are subject to acceptance and availability. I reserve the right to cancel any order at my discretion.

Payment processing

Payment for goods must be made using the available payment methods listed on my website, unless specifically agreed otherwise in advance. You confirm all payment details you provide are accurate and that you are authorised to use the chosen payment method.

Order acceptance and contract formation

A contract for the sale of goods is formed only when I confirm your order. Until then, orders are non-binding. In case of pricing or product description errors, I may cancel or correct the order.

Electronic communications

By placing an order, you consent to receive electronic communications about your order and my products.

Consumer rights and the Consumer Rights Act 2015

You have a right to a full refund or replacement if goods are damaged, mis-described, or not delivered as agreed, under the Consumer Rights Act 2015. If your statutory consumer rights have been breached, please contact me at simonaiken@btinternet.com. These terms do not limit your statutory rights.

Distance selling and your right to cancel

In compliance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

Right to cancel

You may cancel your order within 14 days of receiving your goods (“cancellation period”), subject to the terms below. To cancel, please contact me at simonaiken@btinternet.com or via my website, before the end of the cancellation period.

Return of goods

If you cancel, you must return the goods to me within 14 days of cancellation, unless otherwise agreed in writing. Goods must be returned in their original condition with all packaging and documentation.

Refunds

I will refund you upon receiving the returned goods in acceptable condition (as determined by myself, acting reasonably), using the original payment method. I may make a deduction if the value of the goods has been reduced due to your handling.

Delivery

I will deliver goods to the address you provide when placing your order. Any delivery times are estimates and are subject to change.

Third party terms and conditions

Some website features or services (e.g. payment processors, delivery couriers, external apps) may be governed by additional terms. By using these services, you agree to those third-party terms as well as my own.

What you cannot do

You may not use this website to:

  • violate these terms;
  • engage in illegal activities;
  • damage the website or disrupt others’ use and enjoyment.
External content

Links to external websites are provided for convenience; I am not responsible for their content or for any loss or damage arising from their use. If I integrate third-party applications, your use of them may be subject to separate terms.

Disclaimer, indemnity and limitation of liability

To the fullest extent permitted by law, I disclaim liability for any direct, indirect, or consequential losses from your use of, or inability to use, the website. The website is provided “as is” and “as available,” without guarantees it will be uninterrupted or error-free. By using this website, you agree to indemnify Simon Aiken against any claims arising from your misuse of the website or breach of these terms.

Governing law

These terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.

General

These terms do not create rights for third parties under the Contracts (Rights of Third Parties) Act 1999. If any provision is invalid or unenforceable, the remaining provisions remain in effect. My failure to enforce any provision is not a waiver of my right to do so later. I reserve the right to amend these terms at any time; changes take effect upon posting on the website. It is your responsibility to review any changes.
